4146 Evidence of the daily use of epithets such as "homo" and "motherfuckin' faggot" directed by co-workers and supervisors at plaintiff, a gay man employed as a cook in a youth correctional facility, in the presence of inmates who did the same and sometimes threatened plaintiff with physical harm; and that his supervisors increased plaintiff's workload by instructing inmates not to assist him, although they were assigned to assist other cooks; that co-workers threw trash in plaintiff's work area; and that when plaintiff submitted written complaints, supervisors tore them up in the presence of other employees and inmates; and that plaintiff's promotion was revoked before it took effect was sufficient to justify the conclusion that plaintiff was subject to sexual-orientation harassment that would have interfered with a reasonable employee's work performance and seriously affect his/her psychological well-being, and an award of one million dollars in noneconomic damages was not so shocking to the conscience as to be excessive.CitationHOPE v CYA (Cook's Harassment) 134 CA4 577 [36 154 See: GovC 12900 etseq; Miller v Dept of Corrections 36 C4 446, T/AT 8/05]
