p1586 The trial court erred by granting the anti-SLAPP motion of a city council that passed a resolution condemning plaintiff for hiring a private investigator to investigate a possible conflict of interest between the city attorney and city manager. While the resolution qualified for protection under Code of Civil Procedure ยง 425.16, plaintiff showed a likelihood of success on the merits because a pre-litigation investigation is sufficiently related to the right to petition to warrant constitutional protection.
