4982 In a case involving a fatal automobile accident at a railroad crossing, the trial court erred by denying the Public Utility Commission's motion for summary adjudication on the issue of the Commission's control over the crossing. The fact that the Commission had regulatory authority over the crossing did not establish control within the meaning of Government Code, § 830.
